It's possible some controls' scale values are set to zero. Those should be one. This looks like the default pose. If you bring in a brand new reference of Malcolm, the problem should go away. It is not built in, you're correct.
You can add a new constraint to the parent of the ctlArmIk (or whatever it's called) to the head joint, or reparent one of the constraint targets to the head joint.
(you will probably have to import the reference for that to work.)

There is nothing built into the rig to allow separate arms and legs.
For those who have done this, they duplicate the entire rig, then they have the option of deleting or hiding parts of the geometry and body.

I'm not sure I'm following you exactly. Are you saying when you use other smooth levels, it ruins the texture? You should apply in the non-smoothed 0 setting. You can also render with Mental Ray to avoid using the poly smooth feature. Regarding the pants, I don't believe there are UV's on the pants.
